The New Build Conveyancing Process explained
Navigating the process of buying a new build can feel overwhelming, but we’re here to help:
Reservation Agreement
Once you choose your new build property, you’ll sign a reservation agreement and pay a reservation fee. This reserves the property for a specific period of time.
Reviewing the Contract
Our team will carefully review the developer’s contract, ensuring it includes crucial details such as completion dates, warranties and specifications.
Searches and Checks
We conduct detailed searches on the property and the land it’s built on to identify potential issues, such as access rights or planning permissions.
Exchange of Contracts
We’ll guide you through signing the contract and transferring your deposit, ensuring all paperwork is in order.
Completion
When the property is ready, we’ll manage the final payment and ensure you receive the keys to your brand new home.
1. Understanding Timelines
Developers often expect contracts to be exchanged within 28 days. To stay on track, it's essential to have your financing in place and a lawyer appointed early on. This preparation can help save valuable time and ensure the process runs smoothly.
2. Check for Warranties
Ensure your property comes with a structural warranty, such as NHBC, offering peace of mind for at least 10 years.
3. Clarify Costs
Be aware of additional costs like management fees, service charges, or the cost of upgrades.
4. Visit the Site
Whenever possible, visit the site and show homes to get a realistic understanding of the property’s layout and quality.
5. Communication
Maintain regular contact with your lawyer to avoid delays or misunderstandings.
New Build Developments
Working closely with developers allows us to gain a deeper understanding of the whole development. The process can be made much quicker if we work on more than one property from the same development. There are a number of documents that will be relevant to multiple properties, which we can port across cases to complete the legal side of a new build purchase faster.
When we are working directly with developers, we also have the opportunity to order searches on properties upfront. This process usually takes up to 4 weeks, but with the very short timescales that come with new build properties, we need to order these as soon as possible - and this is where our close relationships with developers comes in handy!
